A Philadelphia-area attorney has recently filed a class action suit against Microsoft, under the allegation that he was cheated out of Microsoft Points when they were deducted for a digital download that did not complete.
Samuel Lassoff, of Horsham, PA, said an invoice he received from Microsoft in early January included charges for purchases that didn’t finish due to a fussy download, but he claims that the charge was no mistake.
According to papers filed in the US District Court for Eastern Pennsylvania and discovered by InformationWeek, Lassoff charges that Microsoft actively “engaged in a scheme to unjustly enrich itself through their fraudulent handling.”
Lassoff further claims that he and “hundreds” of other Xbox LIVE users have been overcharged. “Microsoft breached that contract by collecting revenues for digital goods and services which were not provided,” Lassoff said in his filing.
While none can predict the outcome of the pending case, it does appear rather unlikely that a decision will fall in Lassoff’s favor. The seemingly serial litigant has a string of lawsuits filed against big companies. PACER records reveal that he sued Google in 2006, alleging that his advertisements fell prey to click fraud, and he also sued Bally’s Casino in Atlantic City in 2005, claiming he was attacked by a drunken patron.
